Age Discrimination?


Question: A week or so ago a memo came round the office informing us that due to difficult trading conditions that the company where looking for volentary redundencies and early retirement. The place isn't waht it used to be, someone even dropped a stapler onto my head from a window the other day! After careful consideration, I'm not getting any younger, need a change of pace etc. I, with a heavy heart, put myself forward for early retirement. Now they have thrown it back in my face. They claim you can't retire 35+ years before the state retirement age...they are the ones who wanted volunteers for early retirement. Does anyone think I have a case for age descrimination. Your thoughts please
Answers: Management has done stranger things so this one doesn't really suprise me.

Companies are funny when they're trying to save money by getting rid of older workers aren't they? That's why they were stunned when you (someone who must be about 30) volunteered for early retirement. Reason being, It'd probably cost them more for you to take early retirement and paying you a pension for 35 years would add up quite nicely. With today's job market, that's just not practical. So even though the company offered early retirement to everyone they really should have been more specific.

So in a way, yes, you have a case for age discrimination because an offer was made to you and then refused upon your acceptance due to your age. However, no court in the land would rule in your favor because it should be obvious they didn't mean to make the offer to someone your age. It was a mistake and would be treated as such, not discrimination.
no you don't have a case for age discrimination. you aren't old enough for retirement. if you don't like your job- quit but find another one that you do like before you quit this one.

Whether it is age discrimination or not, I would get the hell out of any working environment that drops stationary on your head. Today it is a stapler, tommorrow a photocopier!

No u have to be at least 65 or older to retire.
